Symantec slaps a lawsuit on Microsoft

Symantec has sued Microsoft over the misappropriation of its volume management software.

Symantec claims that Microsoft has wrongly incorporated patented technology into products like the next version of the Windows operating system.

Symantec has asked a US District court to halt the development of Microsoft’s Windows Vista. The lawsuit seeks an injunction to "preclude the further development, sale or distribution" of the upcoming Windows Vista operating system until the Veritas technology is removed.

According to Symantec, the Veritas (now Symantec) storage management software, licensed by Microsoft for years has been used in the development of a number of Windows products including Vista. The contract had allowed Microsoft to use a technology called Volume Manager, which when applied to its operating systems enabled its users to manage a large flow of data. However, Symantec claims that Microsoft used this technology as the basis of a product the latter developed and named the Logical Volume manager.

Says David Sykes, GM - Pacific Region, Symantec, “We (Symantec and Microsoft) have been trying to work out this amicably. Although, it’s in the hands of external lawyers now, we are working with Microsoft on this. “

The Symantec lawsuit also claims that Microsoft unlawfully persuaded the US Government to grant the company patents, which were based on Veritas’ intellectual property.
